Police from the Troop K barracks in Poughkeepsie charged Albert C. Wagner Jr., 46, with aggravated driving while intoxicated, a class E felony after stopping him in the routine traffic stop Sunday, said police.

While interviewing Wagner, troopers reportedly observed indications that he was under the influence of alcohol at the time of the stop, according to police.

Wagner was charged with felony driving while intoxicated when an alleged criminal history revealed a previous driving while intoxicated related conviction from October of 2012, police said.

Wagner reportedly provided a positive breath sample that revealed an alleged blood alcohol content of 0.29 percent, which is more than three times the legal limit of intoxication, according to police.

He was issued traffic tickets directing him to appear before the Town of Stanford court Jan. 6, police said.
