Westchester Burger Addresses Board's Concerns

MOUNT KISCO, N.Y. – Westchester Burger Company owner Vincent Corso issued an apology to members of the Mount Kisco Planning Board at their meeting Tuesday for failing to address site plan violations in a timely manner, thus beginning the restaurant’s quest to get its outdoor seating back.

At the board’s last meeting, June 26 , which Corso said he had gotten permission to miss from the building office, members authorized village building inspector Austin Cassidy to issue violations and shut down the restaurant’s 13 outside tables, which had been granted on a temporary basis.

Corso assured the board he had fixed all the issues they cited, including those involving the property's garbage area, lighting, shrubbery, fencing and plumbing.

“We all feel that we've actually made wonderful improvements to what the front of our building looks like from what the town of Mount Kisco had to look at prior to us getting there,” Corso said.

Planning board chair Joseph Cosentino then brought up concerns about parking versus seating capacity.

“You’re very successful with what you’re doing and we're proud of you for doing that,” he said, but since former occupants 353 Restaurant and John’s Best never enjoyed the same degree of success, the possibility that every seat might be filed at peak hours more than one night per week is problematic.

Consentino said while the restaurant’s property supports a capacity of 154 people, including those seated at outdoor tables, the site plan of record shows the property only has enough parking spots for 129 people. In the meantime, he said, people are parking illegally across the street and in other lots.

The board told Corso to get written permission from Sleepy’s Mattress Store next door to use their 25 parking spaces during the restaurant’s peak hours of 5:30-8 p.m.

Corso said he already spoke with Sleepy’s and plans to get the agreement paperwork to the board before its next meeting, Aug. 28.

“If this board determines that your peak hours are substantially different from the neighboring property, it’s all good,” said Village Attorney Whitney Singleton. “But right now, without the agreement, that they can’t do.”

Board members Doug Hertz and Anthony Sturniolo also brought up landscaping issues, saying they would like to see more green space. Corso, however, said he had followed the board’s landscaping directions exactly.

Village planning consultant Nanette Bourne suggested the board visit the property to look at the current plantings and try and find opportunities for visual enhancement.
