On Wednesday, acting Westchester County District Attorney James McCarty announced that Rasheed Smalls, 45, has been sentenced to between one and three years in state prison after being found guilty of a felony charge of committing a criminal sexual act and a misdemeanor count of official misconduct last month.
According to McCarty, on July 28 last year, Smalls was on duty at the Bedford Correctional Facility when he entered a utility closet in one of the housing units with his female victim and engaged in oral sex with her, “purely for his own personal satisfaction.”
“The oral sexual conduct occurred at a time when the victim was incapable of consent by virtue of her being an inmate committed to the care and custody of the New York State Department of Corrections and Community Supervision,” McCarty noted, adding that McCarty “abused his authority and position” as a corrections officer.
Smalls has been remanded to the custody of the New York State Department of Corrections. He will have to register as a sex offender upon his release.
