Westchester Commercial Waste Hauler Charged With 40 Counts Of Fraud, Theft

BRIARCLIFF MANOR, N.Y. -- A Florida resident was charged Friday with a 40-count indictment for a fraud and theft scheme centered around a trash hauling business based in Briarcliff.

Stephen DiSalvo, a 60-year-old Florida resident, was charged Friday with 19 counts of forgery in the 2nd degree, a Class C felony, multiple counts of grand larceny, four counts of petit larceny and one count of scheme to defraud in the first degree. 

In Nov. 2015, Christopher C. Leggio and Christopher E. Leggio, two Brewster residents along with DiSalvo were charged with altering several hundred dump tickets to reflect a higher tonnage of solid waste tickets for their company ATNM Corp, according to the Westchester County District Attorney's Office. 

These false dump tickets, attached to  invoices, were submitted to a solid waste hauling broker for payment. As a result of this scam, the broker, relying on the fraudulently altered dump tickets, paid over one million dollars to the defendants, according to the Westchester County District Attorney's Office.

Further investigation revealed that the charged individuals had in fact been stealing from several of the  customers since at least 2010 and that DiSalvo had participated in falsifying, forging and altering over 3,000 dump tickets issued from at least six different weigh stations in and around Westchester County, leading to the larceny of over $2,000,000.00 from approximately 20 victims, according to the Westchester County District Attorney's Office.

Since then, Christopher E. Leggio, 21, has pleaded guilty to scheme to defraud in the second degree and faces a maximum of one year in jail. Christopher C. Leggio, 57, has pleaded guilty to grand larceny in the first degree and faces a maximum of eight  to 25 years of imprisonment when he is sentenced, according to the Westchester County District Attorney's Office.

DiSalvo has a previous conviction for grand larceny and he lost his Westchester County solid waste hauling license in 2003, according to the Westchester County District Attorney's Office.

Because of DiSalvo’s prior conviction, he faces a minimum of 4.5 to nine years and a maximum of 12.5 to 25 years in prison if found guilty, according to the Westchester County District Attorney's Office.

DiSalvo pled not guilty to the indictment and his bail was set at $50,000. He is due back in court on Dec. 21, according to the Westchester County District Attorney's Office.
