BEDFORD, N.Y. — A Purdys man was charged Friday with driving while intoxicated by alcohol and marijuana, according to Bedford police.
Erik B. Gins, 22, was driving a 2003 Ford at 55 mph in a 45 mph zone on Jay Street, police said.
He was pulled over on Cross River Road in Katonah at 1:15 a.m. The officer said Gins smelled of alcohol and marijuana. When asked, Gins told the officer he had been drinking and smoking a few hours prior, police said.
Gins failed field sobriety tests and measured 0.12 percent blood alcohol content, police said. He was also evaluated by the department's drug recognition expert and submitted to a urine test, the results of which are pending.
He was charged with driving while intoxicated, driving while intoxicated with a blood alcohol level over 0.08 percent, and driving while intoxicated with alcohol and drugs in combination, all misdemeanors. Gins also was charged with two traffic infractions: speeding in a posted zone and broken headlights.
Gins was released on his own recognizance and is due Oct. 11 in Bedford Town Court.

Aggravated DWI: Karen M. Martabano of Cross River was charged with driving while intoxicated and aggravated driving while intoxicated, both misdemeanors, on Friday, Sept. 28, police said. An officer saw her 2011 Cadillac making a turn onto Route 35 without signaling, then proceeding east and crossing the double yellow lines, police said. Martabano, 58, was stopped on Cross River Road in Katonah. She failed field sobriety tests and measured 0.20 percent on the Breathalyzer, according to police. Martabano was also issued traffic infractions. She was released on her own recognizance and is due Oct. 11 in Bedford Town Court.
