Kerry Kennedy Pursues Dismissal Of Driving Charge

ARMONK, N.Y. – Bedford Resident Kerry Kennedy was back in North Castle Town Court on Tuesday night, this time seeking dismissal of an impaired driving charge from her July car accident on Interstate 684 in Armonk. Her next court appearance will be May 7, once again in Town Court.

Justice Elyse Lazansky breezed through Kennedy’s case, only announcing dates for the following procedures:

  • March 1: Defendant’s motion
  • March 26: People’s response
  • April 9: Defendant’s response
  • May 7: Ruling on the motion for dismissal

Before Tuesday night, the most recent development connected to Kennedy’s case was in relation to the truck driver she was accused of colliding with while driving impaired. The driver, Dutchess County resident Rocco Scuiletti, pleaded guilty in November to a count of disobeying a traffic device. He, unlike Kennedy, chose to take a plea deal.

Kennedy, who pleaded not guilty to the charge of driving while ability impaired, claimed she suffered from a "complex partial seizure" while driving. Results of a neurological test at Mount Sinai Medical Center showed the blackout was caused by a seizure, but toxicology tests revealed she had the prescription drug Ambien in her system at the time.
