MOUNT KISCO, N.Y. Justice John Donahue is expected to set a trial date for Douglas Kennedy when he appears Thursday night in Mount Kisco Town Court.
The January incident that led to charges against Kennedy occurred at Northern Westchester Hospital in Mount Kisco, when Kennedy, son of the late Robert F. Kennedy, was reportedly taking his newborn son, Bo, out of the maternity ward. Kennedy has said he removed his son for some "fresh air."
According to published reports, two nurses, Anna Lane and Cari Luciano, saw him and attempted to stop him. In sworn depositions, Lane said Kennedy twisted her arm and Luciano said he kicked her.
Kennedy has pleaded not guilty to two counts of harassment and endangering the welfare of a child, misdemeanors. Charges of child abuse were dismissed in April.
On Thursday, according to Kennedys lawyer Robert Gottlieb, the justice may also rule on the hospital's motion, heard in court on June 14, to quash Kennedy's subpoena of 30 pieces of evidence, including surveillance video and medical, insurance and personnel records for the nurses.
Kennedy said obtaining those materials will allow him to defend himself adequately at trial, as they provide the jury with information about the nurses' health so juror's can assess their depositions credibility.
Dan Lutz, communications manager for the New York State Nurses Association, said nurses would picket the proceedings again Thursday night, as they did at Kennedys previous court appearances in April and June.
